There are many provisions in FIPPA that limit what information Baycrest Hospital can disclose. If such exemptions or exclusions apply, the requested record may be completely withheld or only partially disclosed. When responding to all access requests, Baycrest Hospital will issue a decision letter which will explain, in detail, what provisions of FIPPA were applied and give reasons for any nondisclosure of information.
The Freedom of Information and Protection of Privacy Act does not apply to the following type of records:
- Personal Health Information
- Records related to the operations of the Baycrest Foundation
- Records related to a physician’s personal practice
- Records related to charitable donations made to Baycrest
- Records related to certain labour relations, employment and placement matters
- Records related to certain physician and dentist appointment and privileging matters
- Certain records associated with research (including clinical trials)
- Certain records related to teaching materials
Under FIPPA, Baycrest may refuse to disclose the following types of records:
- Third party information
- Another individual's personal information
- Certain records related to advice or recommendations
- Certain records that could prejudice the financial or other specified interests of Baycrest
- Information subject to solicitor-client privilege
- Information that could be reasonably expected to endanger the health or safety or an individual
- Information already publicly available or soon to be published
If you are not satisfied with Baycrest’s response to your Freedom of Information Request, you have 30 days from the date of our decision letter to request a review by the Ontario Information and Privacy Commissioner:
